1 - INTRODUCTION

CAROCIM France is registered in the RCS of Aix-en-Provence under number 500 480 975, whose registered office is at 1515, Route du Puy Sainte-Réparade CS70040 13089 Aix-en-Provence, France. Its email address is carocim@carocim.com.

Any order implies the customer's acceptance of the present general terms and conditions of sale deemed known to them and to which they cannot oppose any clause that has not been the object of our express and written acceptance.

2 - ORDER CONFIRMATION

When ordering online, the contractual information is confirmed by email to the email address indicated by the customer.

3 - PRODUCT INFORMATION

Every effort is made to ensure the accuracy of the information in the showroom and at www.carocim.com.

CAROCIM cannot be responsible for the installation and treatment of tiles. Therefore, it is strongly recommended to read and follow the instructions communicated regarding this matter.

4 - PERIOD OF VALIDITY OF THE TENDER AND ITS PRICE

Product availability shown on the website displays what is available at the moment at which the customer is consulting the website. Our prices are valid for two months.

5 - DELIVERY METHOD

The tiles are delivered to the address indicated by the customer on the order form, only on the ground floor.

All tiles leave our warehouse in perfect condition. Upon receipt of the package, the customer must report to the carrier (or mailman) the slightest sign of impact (holes, crushing, etc.) on the box and, if necessary, refuse the package.

6 - DELIVERY ISSUE

As with any shipment, it is possible to suffer damage, delay, or product misdirection. In such a case, the carrier is responsible and contacted to initiate an investigation.

CAROCIM France cannot be held responsible for delivery delays or problems due to the carrier, loss of products, bad weather, or strikes.

Any issue concerning the delivery (damage, good discrepancy or missing vs. what is indicated on the packing slip, damaged packages, broken tiles, etc.) must be reported on the delivery slip in the form of "handwritten reservations" on the driver/delivery agent’s receipt.

This document must be sent to the carrier within two (2) business days of the delivery date by registered mail with acknowledgment of receipt stating the issues suffered.

A copy of this letter should also be sent to CAROCIM France 1515 Route du Puy Sainte-Réparade CS70040 13089 Aix-en-Provence, France, or by email at carocim@carocim.com.

7 - QUALITY ISSUE

The customer must formulate to CAROCIM France, at the latest on the third business day following delivery, any complaint of delivery error and/or non-conformity of the products in kind or quality vs. the information given on the purchase order.

After this period, any complaint will be rejected. The complaint must be sent to CAROCIM France at carocim@carocim.com.

Any complaint that does not comply with the above-defined rules and within the set deadlines will not be liable to CAROCIM France.

If goods are returned to CAROCIM, they must be shipped in their original packaging.

8 - RIGHT OF WITHDRAWAL

The right of withdrawal applies to individuals who have made a purchase remotely.

The customer has a period of fourteen (14) calendar days to return, at their expense, the products that do not suit them. This period runs from the day after receipt of the customer’s order. Any return must be reported in advance to carocim@carocim.com. The product must be returned to CAROCIM France 1515 Route du Puy Sainte-Réparade CS70040 13089 Aix-en-Provence, France.

Only products returned in their entirety on a film pallet, in their complete original packaging, intact and in perfect resale condition, will be accepted. Any product that has been damaged or whose original packaging has been damaged, will not be refunded, returned, or exchanged. This right of withdrawal is exercised without penalty, except for shipping and return costs. In the case of the exercise of the right of withdrawal, the customer has the choice to ask for a refund of the sums paid with the return of the tiles or a product exchange. Custom-made tiles, decommissioned or purchased on sale, cannot be returned or exchanged.

In the case of an exchange, the customer will pay new shipping fees.

9 - PAYMENT

On the online store, payment is made in full at the time of order confirmation.

For Showroom orders and those placed directly with CAROCIM, the rules are as follows:

- If immediate delivery: Payment is made in full at the time of order confirmation.

- If deferred delivery: 50% on order and 50% before any shipment or on-site pickup.

These payment conditions do not apply for professionals/ resellers (account customers).

10 - TITLE RETENTION

The customer becomes the owner of the goods only after payment in full.

 

11 - DISPUTE / JURISDICTION OF COURTS:

Any dispute relating to the interpretation and execution of these general terms and conditions of sale is subject to French law. In the event of a dispute or complaint, the customer will first contact CAROCIM France to obtain an amicable solution.

It is agreed that the Commercial Court of Aix-en-Provence will have sole jurisdiction in the event of a dispute concerning customers or commercial companies.
